The rental policy of the Lakes at Boca Raton Homeowners Association (the “Association”) is fully operational effective July 1, 2010.
As of that date, every Owner (the “Landlord”) seeking to lease or re-lease a Property they own in Lakes at Boca Raton must submit a Notice of Intent to Lease to the Association.
Every prospective renter must submit a Rental Application form and application fee. If any lease is fully executed prior to July 1, 2010, Landlord and Tenant will not be required to submit the Notice of Intent to Lease or the Rental Application, subject to a copy of the fully executed lease being received by the Association prior to July 1, 2010.
Any Tenant whose current lease began prior to July 1, 2010 will be subject to the same procedures upon renewal as if they were new prospective renters, unless such Tenant has been a continuing resident of the Lakes at Boca Raton since July 1, 2008.
Once the fully completed Notice of Intent to Lease and Rental Application forms plus the $200 application fee are received by the Association, it will commission a thorough background check of all Applicants, followed by an interview with the Property Manager.
While the Association has 30 days to approve or disapprove a prospective renter, every effort will be made to render a decision as quickly as possible to expedite the rental process.
Rental Restrictions
The following restrictions govern the renting of any Property in Lakes at Boca Raton:
No Landlord or Tenant may sublet any Property.
No Landlord or Tenant may lease any portion of any Property.
No Landlord may lease a Property to more than two unrelated adults 18 years of age or older.
No Landlord may lease a Property if their Association account is in arrears with regard to assessments and violation fines. A Landlord whose account becomes delinquent during the course of a lease term is subject to having the Tenant pay rent directly to the Association until the Owner’s account is again current.
Rental Application
Rental Applications must be submitted on the Association’s Rental Application form. The Association will not accept a form supplied by a real estate brokerage, a Landlord, or any other source.
The rental application fee is $200, regardless of the number of Rental Applications submitted by the prospective renters.
A complete Rental Application must be submitted by each person 18 years of age or older, including each spouse. Each such person shall be designated an Applicant until Association approval, and a Tenant thereafter.
The name, birth date and relationship of occupants less than 18 years of age to Applicant must be listed on the Rental Application. Any occupant changes during the term of the lease must be reported in writing to the Association.
Background Check
The background check includes credit history, criminal record, prior residences, employment history, banking information, personal references and relationship verification.
The submission of false information on the Rental Application is grounds for immediate rejection or, if the Tenant has already occupied the Property, eviction.
Lease Provisions
The lease between the Landlord and the Tenant must include a Uniform Lease Addendum provided by the Association. The Uniform Lease Addendum must be signed by both parties to the lease and become part of that lease. A copy of the fully executed lease must be submitted to the Association prior to occupancy.
The minimum lease term is six (6) months. The maximum number of rentals during a 12-month period is two (2).
A copy of any lease renewal must be provided to the Association on or before the start of a new lease term.
If the Landlord and Tenant agree to extend an expired lease on a month-to-month basis, a copy of any such agreement must be submitted to the Association. Month-to-month extensions are permitted for up to six months, following which the parties must revert to a regular lease for no less than a six-month term.
Governing Documents
Upon receipt of the completed Notice of Intent to Lease and the Rental Application forms, the Association will provide the Applicant with a packet of the relevant sections of the Association’s Governing Documents that pertain to resident behavior while residing in Lakes at Boca Raton. The Applicant is expected to be familiar with the packet’s contents for the interview with the Property Manager.
