The Violation Schedules
As homeowners, we have all agreed to abide by a set of rules to maximize the value of the property we own in Lakes at Boca Raton.
Unfortunately, some do not always comply with the minimum standards that we all agreed to uphold when we purchased our homes. If a homeowner opts not to correct violations in a timely manner, then our management company will refer them to the HOA’s Compliance Committee. We hope that all violations are resolved quickly to forego the need for further action by the Compliance Committee. If you correct the violations that are brought to your attention and cooperate with our management company in complying with our Association’s Governing Documents, then the violation schedules will not apply to you.
The Compliance Committee is guided by the two violations schedules that appear below. These are used to conduct their mission of enforcing the HOA’s Governing Documents.
The Transient Violations Schedule is comprised of violations that are usually short in duration but may be repeated over and over again, such as failure to pick up after your dog or putting out refuse at curbside early. The Compliance Committee may vote to impose a fine of up to $100 each time a transient violation occurs.
The Ongoing Violations Schedule consists of violations that last until they are remedied, such as erecting or altering a structure without prior written approval or failure to open/remove hurricane shutters after a storm passes. The Compliance Committee may vote to impose a fine of up to $100 for an ongoing violation which, if not remedied within a reasonable period of time, can be imposed on a daily basis.
Homeowners will receive at least 14 days notice prior to any hearing at which a fine or suspension of privileges is being considered. Any homeowner will have the opportunity to present their case before the Compliance Committee. In addition to fines, the committee may vote to revoke a homeowner’s Common Area privileges for up to 60 days as provided for in the Schedules below. A fine and/or a suspension can only be imposed if the majority of the committee members at the meeting votes to do so.

GROUND MAINTENANCE ON PARCELS
· Failure to maintain landscaping standards.
· Not keeping grass, hedges, shrubs, vines and plants of any type neatly trimmed, mowed, fertilized, and free of weeds, irrigated, as needed, so as to maintain the same in a neat and attractive manner.
· Not maintaining and/or using sprinklers to maintain landscaping standards
· Not removing dead trees, shrubs, vines and other plants.
· No vegetation, rubbish, debris, garbage, refuse or other waste materials of any kind shall be placed or permitted to accumulate upon any portion of a Parcel.
· No building materials can be placed or stored on any Parcel, unless it will be used within 30 days in construction of buildings or structures on the Parcel. *Roof tiles, hurricane shutters, etc.

MAINTENANCE and REPAIR on PARCEL

Lawn care companies used by a homeowner must be informed of this rule by the homeowner. All vegetation must be removed at time of trimming, or it must be stored by the parcel owner/tenant behind the front of the dwelling until the evening prior to pickup.

· Owner is responsible to the association for violations for their family members, tenants, guests and invitees within the community.
· Leaving garbage, defacing and/or damaging common area by owner, owner’s family member, tenant, and/or guest of invitee.
· No unreasonably loud noises and/or obnoxious odors.
· No intoxicating through alcohol or other substances on any common ground.
· Construction, landscaping and similar activities that produce loud noises are permitted 7am-9pm weekdays, 8am-9pm on weekends.
· GENERATORS may be used when there is no electricity supplied by electric utility company.
